Membership Terms and Conditions
TERMS & CONDITIONS
PRINCIPLE TERMS
1. This agreement commences once you have indicated your acceptance in the Declaration section of this web sign up process.
2. Your membership starts immediately.
3. You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
4. You cannot transfer this agreement to anyone else.
FEES AND CHARGES
5. The Admin Fee / Initial Payment is due from you to us, and is not refundable in any circumstances.
6. The Direct Debit Payment Amount is due from you to us. You are obligated to make the Minimum Number of Direct Debit Payments stated with the first one being paid on the 1st Direct Debit Payment Date and then every month thereafter. For the avoidance of doubt, you are obligated to make every Direct Debit Payment regardless of non attendance, whatever the reason for non attendance may be. Should you fail to make a Direct Debit Payment then the remainder of those Payments will become due immediately.
7. If you fail to pay any monies due under this agreement or if any Direct Debit is returned unpaid or any cheque is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £20.
8. You agree to advise us immediately of any change to the Members Details provided.
9. If you fail to pay any amount due under this agreement for a period of more than thirty days, then we may pass the debt to a third party company for collection. The reasonable costs incurred in employing the third party company will be borne by you including costs in tracing you should you have changed your address without telling us.
RENEWAL
10. In order to extend your membership after completing the minimum number of Direct Debit payments, we will automatically continue collecting the Direct Debit Payment Amount every month. Your membership will be extended by one month each payment. Each payment made is not refundable under any circumstances. This Renewal Direct Debit Payment Amount may only be amended if we advise you in writing giving 30 days notice.
Please note – If your membership included the benefit of a Free Period then we will stop making collections during that Free Period and recommence making collections when this free period has finished.
11. During this Renewal Period the only way to cancel your membership is by cancelling your Direct Debit Mandate directly with your Bank
CANCELLATIONS
11A. Under the "No contract" membership, you are required to provide us with 1 months notice to cancel this. You must fill out the "Thinking of Leaving" form on our website. When you fill out this form you are required to provide us with the details you used on sign up and a valid email address.
11b. We will email you receipt of this form within 7 working days of your submission to the email address you have provided us with. The email will inform you of the final steps needed to cancel your membership which will include cancelling your direct debit after the notice period has expired. We will provide you with the date your notice period expires in our confirmation email to you. Any payments that are taken as a result of you not cancelling your direct debit as advised will be non- refundable in any circumstance.
GENERAL TERMS
12. You agree to comply with the Rules of Membership which are displayed prominently in the Club and relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided we give you advance notice of the change.
13. If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
14. We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you.
Your rights under this agreement will not be prejudiced.
15. This agreement is governed by English Law.
16. We may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules. In this event you will not be liable to pay any further Direct Debit Payments, provided such breach is not deemed by us to have occurred primarily in order to qualify you for a refund.
Membership Rules
- Prices quotes in UK Pounds (GBP,£).
- Your administration fee covers all joining costs; your first session induction with a highly qualified personal trainer; issues you with your proximity membership card; and also covers your first month's membership, no matter which membership you choice.
- All members must be 18 years old or older.
- Opening hours and access are subject to change.
- All memberships for valid for one named person only.
- Abuse of membership, i.e. not paying fee's when due, allowing other persons to use your membership card, continued incorrect use of equipment, verbal or physical abuse of FitSpace or PT staff, will result in the cancellation of the membership immediately and any outstanding fee's, costs from damage or legal fees will be sought from you.
- We have the right to refuse your application for membership.
- During your membership, you must pay your subscriptions whether you use our facilities and services or not.
- We may suspend or cancel your membership and 'membership contract' if, at any time:
- you seriously or repeatedly break these terms and conditions or membership agreement;
- another person uses your membership card to get into any of our clubs, unless you have told us that your card has been stolen; or
- you or your guests use rude or abusive language or violent behaviour at any of our clubs, or if your behaviour puts our other members or team members at risk from harm or affects their interests in some way.
- If we end your membership because of the above reasons, we will not usually allow you to apply for membership to any of our clubs in future and you will not be allowed to enter any of our clubs.
- If we end or cancel your membership for any of the reasons listed here, we will not refund your bank and administration fee, starter payments, monthly subscription or annual payment (if you are an 'annual prepaid' member).
- If you lose or damage your membership card, you must purchase a new one for £15 via our website.
- You will require your name, postcode and date of birth to purchase a new card.
- Once a new card has been requested, your old card will automatically be suspended.
- You will be refused entry to the club if you do not show a valid membership card
- By law, we do not have to pay you compensation for any service, facility or equipment not being available because of health and safety reasons or where it is for the benefit of your membership.
- By law, we do not have to pay you compensation for loss or damage you may suffer unless we fail to carry out our duties under these terms and conditions to a reasonable standard or break any duties we have to carry out by law.
- We will not compensate you if we have failed to carry out our duties due to:
- a fault of your own;
- a third party not connected with providing our services under these terms and conditions; or
- events which we could not have known about beforehand even if we had taken all reasonable care.

FitSpace invites you to visit its website. Access to and use of the site is subject to the terms and conditions outlined herein and all applicable laws. FitSpace reserves the right to modify these terms and conditions from time to time by updating this notice.
This is an offer made by FitSpace to you under whom you are invited to browse, peruse and interact for your own personal education, information and communication with FitSpace. This offer is expressly conditional on your acceptance of these terms and conditions. This Agreement represents the entire agreement between you and FitSpace concerning access to the FitSpace website and takes precedence over all such existing communications and/or agreements.
You acknowledge that whilst every effort is made to ensure that all information contained in the FitSpace website is accurate and up-to-date, FitSpace makes no warranty as to its accuracy and you accept that any and all use of information contained on the FitSpace website is at your own risk. FitSpace shall not be liable for any direct or consequential loss arising from your access to and/or use of or inability to access and/or use the FitSpace website or any erroneous or omitted information contained on the FitSpace website.
You accept that the entire content of the FitSpace website is protected by copyright and that FitSpace is either the proprietor or licensee of all copyright in the material contained thereon. FitSpace reserves all its rights as copyright proprietor of the FitSpace website and prohibits without limitation downloading, distribution, exhibition, copying, adaptation, reposting, modification of and dealing in any copyright material contained therein save as expressly provided herein without the express written authorisation of FitSpace. You are advised that all communications made via the FitSpace website and/or email including but not limited to competition entries is strictly on a non-confidential basis and you hereby grant to FitSpace an exclusive perpetual licence to use the content of any such communication for any purposes whatsoever.
You acknowledge that FitSpace reserves all its rights as proprietor of all its trade marks and logos.
You are advised that any and all images of people and/or places and/or events are lawfully used by FitSpace and that any misuse of these images by you is prohibited. You are further reminded that any such misuses of images may be a violation of copyright law, trade mark law, rights of privacy, publicity and personality, laws of defamation and/or obscenity, communications regulations and other legal provisions.
FitSpace reminds you that they police and enforce their rights vigorously to the maximum extent available under the law.
